These terms govern the use of web hosting, email hosting, domain and related services (the “Services”) provided by ScyHost (“ScyHost”, “we”). By placing an order you accept these terms, the Acceptable use policy and the Privacy policy.
1. Ordering and activation
A contract is concluded when we confirm your payment. Plans marked for automatic setup are activated immediately after the payment is confirmed; other plans and domain registrations are activated manually and we confirm activation by email. You must provide accurate contact and billing details.
2. Prices and payment
Prices are listed on the website in euros. Services are paid in advance for the selected period (monthly or yearly) via PayPal. An invoice is issued for every payment. If a renewal is not paid on time we may suspend the service after notice and terminate it if it remains unpaid.
3. Right of withdrawal and refunds
Consumers have the right to withdraw from a distance contract within 14 days. By ordering, you expressly request that the service start immediately; if you withdraw, you pay for the part of the service provided until withdrawal. Additionally, within 30 days of your first order we refund the hosting fee on request. Domain registration fees are not refundable once the domain is registered, as they are paid to the registry.
4. Your responsibilities
You are responsible for the content you host, for keeping your passwords secure and for keeping your software (e.g. WordPress and plugins) up to date. You must comply with the Acceptable use policy and applicable law.
5. Availability and backups
We take reasonable care to keep the Services available and announce planned maintenance in advance where possible. We make automatic backups as an additional safety measure, but they do not replace your own backups; keep your own copies of important data.
6. Suspension and termination
You can cancel at any time by submitting a ticket; the service runs until the end of the paid period. We may suspend a service immediately if it endangers the server, other customers or third parties, or seriously breaches these terms or the law.
7. Liability
To the extent permitted by law, our liability is limited to the fees you paid for the affected service in the 12 months before the claim. This does not limit liability for intent or gross negligence, or consumers’ mandatory rights.
8. Changes and governing law
We will notify you of material changes to these terms by email at least 30 days in advance. Croatian law applies. For disputes with consumers, the court designated by mandatory law has jurisdiction. See also Company information.
